本課程旨在講授近代刑法的任務、探討刑罰的正當化根據，對於犯罪成立的一般性要件加以說明解釋，培養修課同學理解條文、理論發展與實務運作。課程中將說明犯罪成立的一般性要件，輔以案例說明，並對照實務見解，希望能夠藉此課程培養同學了解刑法思考的不同立場與刑法解釋的基本原理，養成抽象思考刑法理論與日後從事實務工作解決問題的基本能力。上學期的課程講授範圍將以構成要件論、違法論為主。下學期則講授責任論、未遂犯與共犯論。構成要件論重視犯罪行為的危險性、結果與因果關係的理論說明，違法論重視法益侵害的判斷與阻卻違法事由的說明，責任論則重視非難可能性的判斷。未遂犯與共犯論重在說明處罰擴張之根據及其要件。透過全學年的課程，針對有關犯罪成立與否判斷上的問題，培養修課同學思考刑法問題、審查犯罪是否成立之能力。

This course introduces the fundamental principles of modern criminal law, including the objectives of criminal law, the justification of punishment, and the general requirements for criminal liability. Students will examine statutory provisions, legal theories, judicial decisions, and case studies to develop analytical and interpretive skills. The first semester focuses on the theory of offense elements and unlawfulness, while the second semester covers culpability, criminal attempts, and accomplice liability. Upon completion of the course, students will be able to analyze criminal law issues, assess whether the elements of a criminal offense are satisfied, and apply core principles of criminal law in legal reasoning and practice.
